Hand-Painted Pet Portraits

A hand-painted portrait is an artistic interpretation based on the customer’s submitted reference photograph.

The artist will make reasonable efforts to capture the pet’s recognizable appearance, expression, markings, and character. However, a hand-painted portrait is not expected to be an exact photographic reproduction.

Differences arising from artistic judgment, painting technique, reference-photo quality, portrait size, chosen style, or reasonable creative interpretation are not automatically considered production errors.

The displayed sample portraits are intended to demonstrate the general style and quality of work. Each completed portrait will be unique.

7. Personalized and Custom Orders

Many products sold through The Ever Paw are personalized, custom-made, made to order, or produced according to information submitted by the customer.

Personalization may include:

  • Pet names;
  • Human names;
  • Dates;
  • Memorial messages;
  • Engraved text;
  • Photographs;
  • Paw prints;
  • Artwork;
  • Color selections;
  • Size selections;
  • Product styles;
  • Portrait instructions;
  • Number of pets;
  • Framing choices; and
  • Other customer-selected details.

Customer Responsibility

You are responsible for carefully reviewing all information before submitting an order.

This includes checking:

  • Names;
  • Dates;
  • Spelling;
  • Capitalization;
  • Punctuation;
  • Numbers;
  • Product size;
  • Color;
  • Style;
  • Quantity;
  • Number of pets;
  • Uploaded photographs;
  • Shipping address; and
  • All other customization instructions.

We will normally reproduce the information submitted with the order as provided.

We are not responsible for errors that accurately reflect incorrect or incomplete information submitted by the customer.

8. Reference Photograph Requirements

Customers ordering photo-based or portrait products must provide photographs that are reasonably suitable for production.

A suitable photograph should generally:

  • Clearly show the pet or subject;
  • Be sufficiently bright and in focus;
  • Show important facial features and markings;
  • Avoid excessive blur or pixelation;
  • Avoid filters that significantly change natural colors;
  • Avoid important areas being covered or cut off; and
  • Be of sufficient resolution for the selected product.

We may contact you if a submitted photograph is unclear, incomplete, unsuitable, or likely to produce an unsatisfactory result.

Processing time may be delayed until an acceptable photograph or complete personalization information is received.

If you do not respond within a reasonable period, we may:

  • Place the order on hold;
  • Continue using the best available information;
  • Adjust the estimated completion date; or
  • Cancel and refund the unfulfilled order, subject to any non-recoverable costs already incurred.

We do not guarantee that every photograph can be successfully used for every product.

9. Customer Authorization for Submitted Content

By submitting a photograph, image, paw print, name, text, artwork, design, message, or other material, you confirm that:

  • You own the material or have permission to use it;
  • You are authorized to provide it to us for the requested purpose;
  • Our use of the material to create and fulfill your order will not knowingly violate another person’s rights;
  • The material is not unlawful, fraudulent, threatening, abusive, hateful, obscene, or otherwise prohibited; and
  • Any identifiable person shown in the material has been included with appropriate authorization where required.

You retain any ownership rights you may have in the original material.

You grant The Ever Paw a limited, non-exclusive, worldwide, royalty-free license to access, copy, adjust, crop, resize, reproduce, transmit, share with necessary production partners, and otherwise use the material solely as reasonably necessary to:

  • Review the order;
  • Create the personalized product;
  • Communicate with you;
  • Complete quality inspection;
  • Package and fulfill the order;
  • Arrange corrections, remakes, or replacements;
  • Resolve customer-service matters; and
  • Establish or defend an order-related claim or payment dispute.

This limited license does not automatically give us permission to use customer-uploaded photographs or completed personalized products in public marketing.

We will not intentionally publish or use customer-uploaded photographs or personalized designs for promotional purposes without separate permission.

10. Prohibited Personalization Content

We may refuse, suspend, or cancel an order containing material that we reasonably believe is:

  • Illegal;
  • Fraudulent;
  • Infringing;
  • Defamatory;
  • Threatening;
  • Harassing;
  • Hateful;
  • Discriminatory;
  • Obscene;
  • Sexually exploitative;
  • Violent or abusive;
  • Harmful to children;
  • Intended to impersonate another person;
  • Intended to facilitate wrongdoing;
  • In violation of intellectual-property rights; or
  • Otherwise inappropriate for production.

We are not required to reproduce every image, message, symbol, or instruction submitted by a customer.

If an order is refused before production begins, the relevant payment will normally be refunded.

If material is later found to violate these Terms after work or production has already begun, any refund may be reduced by reasonable non-recoverable costs already incurred.

11. Proofs, Previews, and Customer Approval

A digital proof, design preview, or portrait preview is provided only when:

  • The product description expressly includes one;
  • The customer purchases a proof or revision service;
  • We determine that confirmation is necessary; or
  • We separately agree to provide one.

Customers should not assume that every personalized product includes a proof before production.

Where a proof is provided:

  • The customer is responsible for reviewing it carefully;
  • Approval authorizes us to continue production;
  • Production may be delayed until approval is received;
  • Changes requested after approval may require additional payment;
  • Changes may not be possible once production has begun; and
  • A preview displayed on a screen may still differ slightly from the finished physical product.

If the customer does not respond to a proof request within the stated timeframe, we may place the order on hold or proceed using the submitted information where reasonably appropriate.

Approval does not eliminate responsibility for a manufacturing error that occurs after approval, but it may limit claims relating to details that were clearly shown and accepted in the proof.

12. Changes to Personalized Orders

Contact us as soon as possible if you need to change personalization information.

We will make reasonable efforts to assist, but changes are not guaranteed.

Once any of the following has begun, changes may be unavailable or may require an additional fee:

  • Material preparation;
  • Supplier ordering;
  • Design work;
  • Engraving;
  • Printing;
  • Cutting;
  • Sewing;
  • Painting;
  • Framing;
  • Assembly;
  • Packaging; or
  • Shipment.

A requested change may also extend the processing and delivery time.

The customer is responsible for any reasonable additional costs caused by changes requested after production has begun.

13. Orders and Contract Acceptance

Submitting an order and receiving an automated order-confirmation email does not necessarily mean that the order has been finally accepted for production.

The order-confirmation email confirms that we have received the order request.

An order may be accepted when:

  • Payment has been successfully authorized;
  • Required information has been received;
  • The product is available;
  • The submitted customization can reasonably be completed; and
  • The order passes any necessary verification or fraud review.

We reserve the right to refuse, place on hold, limit, or cancel an order for reasonable grounds, including:

  • Product unavailability;
  • Supplier unavailability;
  • Inability to complete the requested customization;
  • Unsuitable reference photographs;
  • Missing or unclear information;
  • Obvious pricing or description errors;
  • Payment failure;
  • Suspected fraud;
  • Unauthorized payment activity;
  • Excessive quantities;
  • Resale activity inconsistent with a personal retail order;
  • Prohibited personalization content;
  • Shipping restrictions;
  • Legal or regulatory restrictions; or
  • Other circumstances that make fulfillment impractical or unlawful.

If we cancel an order before production and no non-recoverable costs have been incurred, the amount paid for the canceled item will normally be refunded.

If we cancel an order because we cannot fulfill it, we will not charge the customer for the unfulfilled product.

14. Product Availability

Products and product options are subject to availability.

We may:

  • Limit quantities;
  • Discontinue products;
  • Change materials;
  • Replace unavailable packaging;
  • Remove customization options;
  • Restrict sales to certain countries;
  • Update product specifications; or
  • Decline orders that exceed available production capacity.

Where a material, chain, frame, packaging component, or other minor component becomes unavailable, we may contact the customer to offer:

  • A reasonable substitute;
  • An alternative product;
  • A revised completion estimate; or
  • Cancellation of the affected item.

We will not make a material substitution that significantly changes the purchased product without informing the customer.

15. Prices and Currency

Unless otherwise stated, prices displayed on the website are shown in United States dollars (USD).

Prices may change at any time without prior notice. Price changes do not normally affect orders already accepted and paid, except where there is an obvious pricing error.

The price charged will be the price shown during checkout, subject to:

  • Product options;
  • Personalization charges;
  • Quantity;
  • Shipping charges;
  • Applicable discounts;
  • Taxes where collected;
  • Currency conversion by the payment provider; and
  • Correction of obvious errors.

We are not obligated to fulfill an order at a price that is clearly and materially incorrect due to a technical, typographical, system, currency, or data-entry error.

If an obvious pricing error affects an order, we may contact the customer to:

  • Confirm the order at the correct price; or
  • Cancel and refund the affected item.

16. Payments

Payment must normally be completed before production or fulfillment begins.

Available payment methods are displayed during checkout and may change over time.

Payments may be processed by independent third-party providers, including PayPal.

By submitting payment information, you confirm that:

  • You are authorized to use the payment method;
  • The billing information is accurate;
  • Sufficient funds or credit are available; and
  • The transaction is not fraudulent or unauthorized.

We do not control whether a bank, card issuer, PayPal, or another payment provider approves, delays, reviews, converts, or rejects a transaction.

Payment providers may apply:

  • Transaction fees;

  • Holds;

  • Other conditions.

Any exchange rate or fee applied by a customer’s bank or payment provider is outside our control.

17. Discounts, Promotions, and Coupon Codes

Unless otherwise stated:

  • Promotions apply only during the advertised period;
  • Codes must be entered before completing payment;

Processing time and shipping time are separate.

Any delivery date or timeframe provided is an estimate unless we expressly confirm a guaranteed service in writing.

Customers are responsible for providing a complete and accurate delivery address.

Shipping charges, tracking, customs, delivery delays, lost packages, damaged packages, incorrect addresses, and undeliverable orders are governed by our Shipping Policy.

Please review the Shipping Policy before placing an order intended for a birthday, memorial, holiday, anniversary, or other time-sensitive occasion.

20. Customs, Duties, and Taxes

International orders may be subject to import duties, value-added tax, sales tax, customs charges, handling fees, brokerage fees, or other charges imposed by the destination country or service provider.

Unless clearly stated otherwise during checkout, these amounts are not included in the product price or shipping charge paid to The Ever Paw.

The recipient is responsible for applicable import charges and compliance with destination-country import requirements.

Refusing a parcel or failing to pay import charges does not automatically create a right to a full refund.

21. Order Cancellations

Order-cancellation conditions depend on:

  • The time elapsed since purchase;
  • Whether materials have been prepared or purchased;
  • Whether the supplier order has been placed;
  • Whether personalization has begun;
  • Whether artwork or production has started; and
  • Whether the order has shipped.

Customers should contact support@theeverpaw.com within the cancellation period stated in our Return & Refund Policy.

Once personalized production has begun, full cancellation may no longer be available.

Where cancellation is still possible after non-recoverable costs have been incurred, any refund may be reduced by reasonable costs already incurred.

22. Returns, Refunds, and Exchanges

Eligibility for a return, refund, remake, replacement, or exchange depends on:

  • Whether the product is personalized;
  • The reason for the request;
  • The condition of the product;
  • The time since delivery;
  • Whether the issue resulted from customer-provided information;
  • Whether the product is defective, damaged, or incorrect; and
  • The evidence provided.

Personalized and custom-made products are generally not eligible for change-of-mind returns because they are produced specifically for an individual customer and cannot ordinarily be resold.

This does not prevent us from providing an appropriate remedy where an item is damaged, defective, materially incorrect, or affected by an error for which we are responsible.

All returns require prior authorization.

23. Product Care and Use

Customers are responsible for reviewing and following any care instructions provided with the product or on the website.

Depending on the product, care may include:

  • Storing products in a dry place;

Damage caused by misuse, neglect, improper cleaning, modification, accidental handling, normal wear, or failure to follow care instructions is not automatically considered a manufacturing defect.

The products are memorial and decorative products intended primarily for human ownership and use. They are not pet toys unless a product description expressly states otherwise.

24. Reviews, Feedback, and Customer Submissions

You may choose to submit:

  • Product reviews;
  • Ratings;
  • Comments;
  • Feedback;
  • Suggestions;
  • Testimonials;
  • Customer-service messages; or
  • Other content.

You are responsible for the content you submit.

Submitted content must not:

  • Impersonate another person;
  • Contain unlawful threats;
  • Infringe intellectual-property or privacy rights;
  • Contain malicious code;

This license does not automatically include permission to publish private customer photographs, personal correspondence, or customer-uploaded personalization materials.

Where we wish to publicly use a customer photograph or identifiable customized product image, we may request separate permission.

25. Intellectual Property

  • Logo elements;
  • Website layout;
  • Original text;
  • Product descriptions;
  • Graphics;
  • Illustrations;
  • Original photography;
  • Original artwork;

  • Contact the customer with updated information;
  • Offer an alternative;
  • Suspend fulfillment; or

We will make reasonable efforts to review the matter and provide a response.

Nothing in this section prevents either party from using a lawful dispute-resolution procedure where direct communication does not resolve the matter.

36. Governing Law and Jurisdiction

To the extent permitted by applicable law, these Terms and disputes arising from them are governed by the laws applicable at the location from which The Ever Paw is operated, currently Guangdong, People’s Republic of China, without regard to rules that would automatically apply another jurisdiction’s law.

Where a dispute cannot be resolved directly, it may be submitted to a court with lawful jurisdiction in Guangdong, China, unless another forum is required by a rule that cannot lawfully be excluded.

This section does not mean that laws from every country automatically apply merely because they may be more favorable to one party.
